Users of Zetia and Vytorin vs. Schering-Plough & Merck
KGS is investigating lawsuits related to the cholesterol-lowering drugs Zetia (ezetimibe) and Vytorin (a combination of ezetimibe and simvastatin). Zetia was introduced in 2002, and by 2003, it was on the list of top-selling drugs with more than 4.2 million prescriptions written that year. The combination drug Vytorin was introduced one year later, in 2004, but the FDA reviewer of Vytorin recommended against approval of Vytorin. Shareholders vs. Threshold Pharmaceuticals, Inc.
Kahn Gauthier Swick, LLC ("KGS") announces that shareholders of Threshold Pharmaceuticals, Inc. ("Threshold" or the “Company”) (Nasdaq:THLD - News) who purchased shares of the Company between February 4, 2005 and July 14, 2006 (the "Class Period"), including purchasers of shares pursuant to Threshold’s February 4, 2005 Initial Public Offering (“IPO”) and its October 12, 2005 follow-on offering, have until September 4, 2007 to move for appointment as Lead Plaintiff in a securities class action lawsuit currently pending in the United States District Court for the Southern District of New York. No class has yet been certified in this action.
Shareholders vs. Telik, Inc.
Kahn Gauthier Swick, LLC ("KGS") announces that shareholders of Telik, Inc. ("Telik" or the “Company”) (Nasdaq:TELK - News) who purchased shares of the Company between March 27, 2003 and June 4, 2007 (the "Class Period"), including purchasers of shares pursuant to Telik’s November 5, 2003 and January 28, 2005 stock offerings, have 60 days, or until August 6, 2007 to move for appointment as Lead Plaintiff in a securities class action lawsuit currently pending in the United States District Court for the Southern District of New York. No class has yet been certified in this action.

Class actions as well as individual legal actions involving medical or health products or services can arise in a wide variety of circumstances. Most well-known, of course, are actions against drug manufacturers for marketing an allegedly dangerous drug, like the cholesterol drug Baycol, the diabetes drug Rezulin, or the Fen-Phen diet drug combination. Similar actions can be filed against the firms who make allegedly dangerous medical devices, such as Sulzer's knee and hip implants, the St. Gobain Desmarquest artificial hip, or the silzone heart valves made by St. Jude Medical. Class actions have also been filed against the manufacturers of nutritional supplements, such as Metabolife and other products containing ephedra.
Some of these actions, whether based on drugs, medical devices, or nutritional supplements, contend, not that the product was always dangerous, but that the advertising for the product was misleading. Another type of class action that is becoming more common is one against a drug manufacturer claiming that the company has monopolized the drug so as to "fix" its price.
Another common type of legal action is one against the provider of medical services. Many such actions are filed for causing birth trauma to infants, or for other types of medical malpractice. Sometimes, such as in the case of actions against nursing homes, the alleged negligence may be by staff members other than doctors.
