How a National Highway Traffic Safety Administration Recall Works
Last year, the NHTSA issued approximately 1450 recalls/alerts on motor vehicle equipment. After the NHTSA deems a product potentially harmful, the following procedure is enacted:
- Discovery - The NHTSA, through testing or consumer discovery, finds a safety defect in a motor vehicle or child safety seat.
- The Product is Taken off of the Market - The NHTSA uses statutory authority to authorize product seizure, removal from the market, and/or mandatory repair or replacement.
- The Public is Informed - The NHTSA and the company marketing the vehicle or vehicle product issue a national press release. The NHTSA often works with a company to draft a letter to purchasers, dealerships, distributors, etc., to issue a press release, and to determine the scope of the recall.
- Collection of the Product/Repair/Refunds Awarded - The vehicle or product is recalled, collected or refunded, if applicable. Persons owning recalled vehicles are directed toward certified automotive mechanics at dealerships or authorized service centers.
If you suspect that a product you own is defective, contaminated or otherwise the subject of a recall/alert, here are a few steps you can take:
- Immediately cease using the product or, if it is a vehicular issue, take the vehicle to a certified mechanic or the vehicle dealership.
- Check the model number to confirm that the product is defective.
- Consult the National Highway Traffic Safety Administration (NHTSA), Food and Drug Administration (FDA) or the Consumer Product Safety Commission (CPSC).
- Contact the manufacturer.
