How a Food and Drug Administration (FDA) Recall Works
Once the FDA deems a product potentially harmful, it enacts the following procedure:
- Discovery - The FDA, through testing or consumer discovery, finds a food, cosmetic, medicine, medical device, or radiation-emitting product (e.g. microwave ovens) to be contaminated or defective.
- Level of Severity is Established
- Class I Recall - There is a reasonable probability that the use of or exposure to a product will cause serious adverse health consequences or death.
- Class II Recall - Use of or exposure to a product may cause temporary or medically reversible adverse health consequences or where the probability of serious adverse health consequences is remote.
- Class III Recall - Use of or exposure to a product is not likely to cause adverse health consequences.
- The Product is Taken off of the Shelves - The product is removed from the market on a firm's own initiative, by FDA request, or by FDA order under statutory authority.
- The Public is Informed - The FDA and the company marketing the product issue a national press release. The FDA often works with a company to draft a letter to purchasers, distributors, etc., to issue a press release, and to determine the scope of the recall.
- Collection of the Product/Refunds Awarded - The product is collected and refunds, if applicable, are awarded.
If you suspect that a product you own is defective, contaminated or otherwise the subject of a recall/alert, here are a few steps you can take:
- Immediately cease using the product or, if it is a vehicular issue, take the vehicle to a certified mechanic or the vehicle dealership.
- Check the model number to confirm that the product is defective.
- Consult the National Highway Traffic Safety Administration (NHTSA), Food and Drug Administration (FDA) or the Consumer Product Safety Commission (CPSC).
- Contact the manufacturer.
