A statewide class action has been filed in Pennsylvania against Irv Borenstein, Esq. This action is brought on behalf of all Pennsylvania residents who, since December 5, 2002, have received a letter from Borenstein's law firm in an attempt to collect a debt. Consumers allege that certain language contained in the letters sent by Borenstein violate the federal Fair Debt Collection Practices Act and are seeking unspecified compensatory damages, statutory damages and injunctive and declaratory relief.
 
American Express Financial Advisors (AEFA), a division of American Express, was served August 1, 2005 with a motion that asked Federal Court in Arizona to certify a class of more than 500,000 former AEFA clients. The motion was filed by leading plaintiffs attorneys in Arizona. In the Class Certification motion, the former clients allege that AEFA violated fiduciary duties and perpetrated a scheme to defraud its investing clients through the Company's sale of Financial Plans.
 
A class action has been filed in Maryland against Ocwen Federal Bank FSB on behalf of all mortgage borrowers who, since October 23, 1991, have been charged allegedly unlawful inspection fees by Ocwen. Consumers allege that Ocwen has violated state consumer debt collection and commercial laws and has breached its contract with consumers. Consumers are seeking compensatory, statutory and punitive damages, declaratory relief and a permanent injunction and the disgorgement of funds obtained through unjust enrichment.
 
A nationwide class action has been filed against collection agency Gold Key Credit, Inc., on behalf of all US residents who have been wrongly billed overdue charges by the company, its parents, or its subsidiaries. The action alleges that Gold Key has violated the federal Fair Debt Collection Act and the Florida Consumer Collection Practices Act.
