Wells Fargo Home Mortgage - Mortgage Nightmare

My Family and I had an opportunity to move to Texas in October of 2006. When this opportunity became available to us, we placed our home in Kansas on the market. We notified our lender, Wells Fargo Home Mortgage that we were moving and would be needing to purchase a home in Texas. We did so and closed with Wells Fargo on our home here in December of 2006. We were able to make both mortgage payments just fine; Wells Fargo could not keep them straight however. Soon after, we received a check from Wells Fargo in the amount of a monthly payment. The next day they returned the previous month’s mortgage payment to us, not even cashed. Next came the foreclosure papers in the mail. Quinter, Kansas is a very small town and Wells Fargo placed this foreclosure notice in the town newspaper. Alerting everyone that we were subject to a foreclosure. Not being able to get anyone from Wells Fargo to explain these actions, I went straight to the law firm that was suing us on behalf of Wells Fargo and submitted all documentation, bank statements, cancelled checks ect. Showing that we were not behind and our payments and both properties were current. While all of this mess is going on, NW Kansas had a very large ice storm and the power was out for two weeks. The end result was that the pipes in the house shattered and eventually flooded the home. We notified our insurance company and Wells Fargo's property damage department. The foreclosure was dismissed and the potential buyers (one very serious buyer) ran for cover. Note that Wells Fargo did not publish in the town newspaper an 'oops we made a mistake' notice.
The insurance company paid the entire claim except for the portion that they retain until the damage is repaired. We sent the 46,000.00 plus to Wells Fargo as they instructed us to do. Filled out all the paperwork that they eventually sent us. Sent in the quotes from the contractors, ect. All of this required phone call after phone call after phone call. We filled out the property damage claim a total of 4 times, faxed in different sets of paperwork on numerous occasions and have talked to a total of 62 different people from Wells Fargo. At this point, today, we are 19 months into this. Our home has never been repaired, Wells Fargo can not account for the insurance money. Sometimes it is applied to our home loan; sometimes it is going to be transferred to the property damage department. They have taken possession of our house, changed the locks, removed our property from the garage and stored it in some location no one seems to know of. The house is full of mold, has no floor, and the city would like us to tear it down. We have lost the opportunity to claim the remaining insurance money and lost the chance to sell our property. I have contacted law firm after law firm who five me one excuse after another or are priced so high that the normal working family couldn't afford them if they wanted to. I would like someone to explain to me how this mortgage company can do these things and get away with them and how justice for all does not apply to my family in this instance.
