Wells Fargo MortgageWestern UnionPublix Grocery Stores - Errors and Ommissions
I dont know where to start....and I'm sure everyone will find this hard to believe....but...here goes....
In late May of 2008, I inquired about a distress property for sale advertised on Craigs List...
Apparently an investor had purchased this home with a Well Fargo Mortgage, from the original mortgagee with much the same intention I had...using it for a tax write off as rental property...
I got in touch with the original mortgagee on the property and contacted Wells Fargo to negotiate a payback for arrears that the prior investor was unable to make.
After a successful three way call to Wells Fargo Mortgage to set up the re-payment plan. an initial Western Union Money Quick Collect Money Gram was sent five (5) days ahead of schedule to Wells Fargo Mortgage.
Here is where the fun starts....
Due to a clerical error by a clerk at a Publix grocery store, an incorrect Wells Fargo Mortgage account number was entered into the Western Union Payment System, even though my completed 'Quick Collect' form were correct.
The following day, according to Wells Fargo Mortgage, the transaction was rejected, and the funds were returned to Western Union.
Apparently neither Wells Fargo Mortgage, Western Union. or Publix Grocery Stores have any kind of a system in place to manage transmittal rejections. As a consequence to this I had no knowledge that the funds were not posted to the mortgage account.
On the first of the following month, Wells Fargo Mortgage auctioned the house on the courthouse steps and bought the property.
Two days later I called Wells Fargo Mortgage back to make arrangements to remit the second installment for the agrred plan, and was informed that the home had been auctioned off.
After two weeks of dialogue with Wells Fargo Mortgage, the transaction error was discovered, and Wells Fargo Mortgage refused to reinstate the mortgage.
Since they would not acknowledge responsibility for the 'errors and ommissions' of their agents, Western Union and Publix Grocerey Stores and not correct the error, A very nice woman now has a foreclosure on her credit record, and a single father with three children that I had leased the house to, now has to find a new home...
With the way the economy is and the billions of dollars the National Banks are writing off for Mortgage defaults, it amazes me why Wells Fargo Mortgage would make no effort to reinstate the motgage due to the errors of their agents..
To add insult to injury Western Union does not keep records for longer than two weeks of any Quick Collect transaction and I have been calling since the decision by Wells Fargo Mortgage not to reinstate, to collect the funds I had initially sent for the first installment...
I have called Western Union 'Quick Collect' customer service for ten consecutive days to see what the status of my return of my monies to no avail.
It's in accounting.....is the response....and I should get a phone call about the transaction research ...the next day....I have been waiting now nine consecutive days for that call to no avail....
I'd love to hear any other personal experiences others have had like this to evaluate ligitation
