Geneva Roth Capital - Unauthorized access to my accounts

I noticed that 400 had been deposited into my bank account on April 30th, 2008. (The number that was on the transaction line is T6726865.) I did not remember giving any information to any company by the name of ‘Geneva Roth Cap Loan’, which showed as a transaction description on my bank statement. I had been looking for a payday loan online, putting my info in and then backing out at the last minute on several websites. I do not recall giving this company any authorization to access my accounts.
It came the time that I had to file bankruptcy. While gathering information for my lawyer, I found it very impossible to find out where “GRC funding” came from. While trying to save up to pay the lawyer fees I found that I had 3 payments taken out of my bank account of 120 each: May 14th, May 23rd and June 6th.(Transaction numbers shown respectively: T6793049, T6888602 T6995214.) What was very interesting was the description of the withdrawals changed from ‘Geneva Roth Cap Payment’ to ‘Grc Funding’. I had to close out my account to stop these payments. On June 23 I received an IFN notice from my bank that had ‘Grc Funding’ as a returned payment of 120, transaction number T7112448. I emailed my banks and told them that any payments from ‘Grc funding’ are unauthorized. I bank with Wells Fargo and USAA Federal Savings Bank.
I went online and typed “GRC funding” into the search box. I am glad I did, because I found out that GRC funding was linked to a place in Kansas and Utah. I also saw that “GRC funding” was really bad in customer service, threatening people and also depositing and withdrawing money from people’s accounts without permission. On the website “Ripoffreport.com” I found out that “GRC funding” was using Loanpointusa.com to do their business. I wrote an email to the company informing them that I might have an account with them. I then got an email a day later saying that my account was in collections and that I had to call a certain number. I then emailed Kristine Roddy (claimed to be a Loan officer) demanding a contract and they responded with the same message. I wrote that individual once more asking really nicely about getting a contract and have not heard from them since. I informed them in my email that I would be contacting the Better Business Bureau about this dilemma.
I had called the customer service number several times. One time I got hung up on; another time the operator was really rude with me when I couldn’t remember what number I had dialed and the third time I had asked to have my contract sent to me as an attachment in an e-mail. I was also asked if I was aware that I owed 400 and I told the person that I would take care of it as soon as I see the contract. They said that they could send the contract through my email. I checked my email several times to see the ‘contract’ and it never came. I was very frustrated with the costumer service I was receiving, so I decided to research the website a little more.
Loanpointusa.com may seem like a professional website, but it is all that. It does give an address of the company (which I printed up), a phone number and a fax number. Nowhere does it say what bank issues the funds to its customers. I looked at the FAQ’s page and saw that the only way to receive funds through their company was to fax in bank statements, a voided check, and a copy of a driver’s license. In turn they would review the paperwork sent in and then fax back a paper to sign to fax them. I don’t own a fax machine. So I knew that this company had taken my information and without my authorization put 400 in my account and taken several payments of 120 each.
I tracked down loanpointusa.com’s business by typing it in the search box. It is run my Geneva Roth Capital in Utah. It is also linked with another place in Kansas. I then decided to look them up on the Better Business Bureau website and saw that Geneva Roth Capital (both the Utah and Kansas location) is not part of the BBB because of the numerous complaints that they had received from people. I also contacted Utah’s department of finances and filed a complaint. They emailed me back saying that I had to contact the department of finances of Idaho, the state I reside in. Geneva Roth Capital is a licensed loan facility, but I feel they should be shut down and prosecuted for their fraudulent activities.

I will send this same complaint to the following facilities, regardless of getting a response from loanpointusa.com: the Federal Trade Commission, Better Business Bureau, Attorney General’s Office and the Department of Finances of Idaho, Utah and Kansas. I may be tempted to also contact the FBI in Utah and Kansas. I have documented EVERTYHING that has to do with this situation.

I have been keeping track of a forum on Mortgagefit.com, because I had posted a comment about my situation with this company. Look at page 16 at the very bottom...this looks like someone who works with Geneva Roth CompanyCapital pretty much harassing everyone who has been treated very unfairly and feel that they have been scammed. Thought it would be good to post on this website...
