K-Mart - Kmart not honoring advertised PG coupons

K-Mart is currently running an advertised promotion where customers can receive a 10 K-Mart gift card when they purchase a pack of Duracell batteries and 2 Procter Gamble products. The coupons for the promotion were in the form of tear-off pads available in K-Mart stores, prominently displayed in the Health Beauty section. The printed coupons stated in bold caps 'LIMIT ONE COUPON PER PURCHASE' with an expiration of 81307. A scan of the coupon can be made available, originals if needed for a class action.

On 72407 an internal K-Mart communication (scan available upon request) was sent verifying the validity of the deal BUT with 'one per transaction' wording, which is already limiting the manufacturer's coupon beyond what was printed on it.

On 72607 a second internal communication was sent (scan also available upon request) instructing stores to remove the coupons from the stores and honor existing coupons on a 'one per household' basis to 'limit the liability' of the promotion, which is GROSSLY limiting compared to the text of the manufacturer's coupon.


Like others, I was told the PG promotion, that has a coupon that clearly states 'ONE PER PURCHASE', was one per household. Among 4 stores, I have also been told:
I can't use any other coupons in my purchase

I can use any I want, as long as one per purchase, EXCEPT the PG at onehousehold (even though all the PG coupons I had stated 'One per purchase', including the DuracellPGgiftcard coupon)

I have to buy 'larger' PG products, smaller don't count (there are many smaller that are NOT Trial Size)

I have to buy more than 10 in DuracellPG items.


Kmart's own internal memo states that smaller sizes count, as long as they are not trial size.


The month-long Kmart flier makes NO mention of any limits in the section mentioning the coupon (yet right above it on the same page, a Kotex Mail-In Rebate clearly says One Per Household).

The PG coupon doesn't say one per TRANSACTION or HOUSEHOLD, it says 'LIMIT ONE COUPON PER PURCHASE'.

Which means you should be able to use multiple in one TRANSACTION, just like any other PG coupons.

While Kmart has the right to limit the usage, the ad states in the small print on the back 'We reserve the right to limit purchases to normal retail quantities'.

ONE is NOT a 'normal retail quantity' for PG Health and Beauty Aids or batteries (especially during Hurricane Season).

Also, while Kmart may have the right to change the TC of their own promotions, they DO NOT have the right to change a manufacturer's promotion. That is 'bait and switch' per the FTC.

Every K-Mart experience has been a very pleasant one for me. I have went to K-Mart numerous times during this promotion throughout the Cincinnati area, they have been nothing but nice to me. Coupons were out and plentiful, product was in stock and all the CSRs and Managers ran the coupon through, no questions asked.

Most likely the reasons that all these people had issues at K-Mart is bc they were abusing the system, trying to run 50 coupons through at once and exploit the system.
