Washington Mutual - False Reporting and False Fees

This is a letter I have not sent to Washington MutualChase:


I have a situation that I hope you will be able to assist me with. This letter comes to you after I have exhausted all attempts with customer service and bank employees. I own a home in Seattle and currently have an 8020 loan that I have carried with Washington Mutual for over 3 years. I make my payments on the 15th of every month at my local branch, I make sure that my payments are received before 1:00 eastern standard time, which makes it in before closing of that business day on the east coast.

In January of 2008, I made my payment at the branch with a teller. The teller made two payments to the first loan (0696233253) but not the second (0696233261). I did not pick up on this for months. I suddenly started to receive up to 10 calls per day telling me that I am behind on my payments for that particular loan and as well delinquent with multiple late fees assessed.

No matter how much I explained to them the situation, I was told that the error was mine and not the banks regardless of the clear documentation that shows I paid my loans on time. Next, I prepared a thorough presentation of all my payments, with receipts containing the day and times down to the minute that my payments were made, when they posted and when they cleared. I crossed referenced this with printouts from the Washington Mutual web site containing my transaction history for both loans and as well my bank statements from my primary bank, Bank of America. This package also contains my credit reports in which I found Washington Mutual reporting me delinquent for 10 months in 2008. I then went to the very beginning of all transaction history and found that in the last three years I have been assessed late fees and more delinquencies that have been erroneously reported.

The bank manager at my local branch finally began to show interest when he realized that that I was correct in my assertion that I had made all my payments on time. He said he would take care of the situation, but unfortunately delegated this task to another bank employee who once again, dismissed my claims without resolving the errors.

In January of this year, they finally removed the 10 delinquencies they reported to the credit bureaus, by this time however my credit score has suffered greatly and therefore so did my financial goals. Ironically, not even Washington Mutual has been willing to refinance my house because of the poor credit score that their very error had created. With out all these errors , I would have been eligible for a jumbo loan and an interest rate that would have saved me almost 1400 per month.
In addition to the tremendous financial ramifications of this huge accounting error, there has been a significant impact on my personal life. My very rare vacation time I can give myself every few years has been canceled due to this. My 20 year class re will be missed on May 22nd . Spending time with my mother this month will not happen either. My mother is fighting melanoma which is in her lungs and spine and soon her brain, they can only try to slow it down, there is no cure and there is not much time left either.

Will you please help me?

I am not asking for anything more then what I would have been eligible for. My loan accounts need to be corrected to show that I have been in good standing with my loans, this should be sent out to all three credit agencys. All the late fees that have been assessed to my loans should be reversed and as well the loan payment that was applied incorrectly in January of 2008 should be corrected as well . Finally, I want to be able to refinance at the interest rate that my prior excellent credit score would have earned and have all fees and charges of refinancing waived.

I would appreciate hearing from you regarding a plan of action for resolving this matter no later then August 31st so I may straighten out these financial issues quickly enough to be able to spend my time with my mother as she undergoes intravenous chemotherapy.
