Home Warranty of America - Refusal to cover AC unit
I have had a warranty with HWA for over five years now. This spring my AC unit (Trane heat pump) stopped cooling. I contacted HWA and they sent out two different technicians. The first technician listed the coil leaks, tray rusted and primary drain clogged. Since the heat pump was off for the winter and now running all the time, the filter was dirty. He advised me to keep the unit off and pulled the filter for me. I paid him the HWA fee. Another technician came out the next day. He made notes that the system needed a coil, the drain cleared out, and additional parts. No charge from HWA.
The next day HWA informed me that they were not covering this issue because the drain was plugged and it was my fault. The HWA person told me the rust indicated negligence on my part.
I'm unemployed and my wife is also unemployed so we had to save up to have another company come out and look at the unit. He noted that the system is not working due to freon leak and 'This is due to age and normal use. Nothing abnormal.' I had to pay the company for the inspection.
I feel that HWA is not working in good faith. I should not have to pay somebody to tell me that my AC unit is getting old. I have talked to the account person who wasn't all that nice and I have sent a copy of the inspection to HWA. I have kept all the documents. HWA refuses to provide me with a written statement explaining why my claim was refused.
I feel that I have operated in good faith and HWA should honor their warranty.
