In a nutshell, since 2001, I have experience unfair billing practices with this clinic. I am the guarantor on my children's insurance, per my child support decree. Also, per my decree, my ex is supposed to pay 50 over and above any charges not covered by insurance. In 2001 I had found a couple of past due accounts on my credit report, I then called and had spoken with a billing clerk about sending the billing to my house only. She stated that they are legally entitled to send the billing to the fathers house or my house it is there decision. I then asked if they are sending the bill to Paul, why am I the person that they send to collections? She stated because I am the only guarantor on the account. I told her that was untrue because per our court papers Paul is a guarantor for 50 of the portion not covered by insurance. She stated that the documents not affiliated with their company do not matter to them, they will only send me to collections. I asked her for a 'fair' chance to pay the bills and to pull them back from the agencies, she told me No they will not do that, I will have to work with the collection agencies. I again asked why they send the billing to Paul's house, she said it's because he is a guarantor on the account. I recapped our conversation to her, her response is that Paul isn't a guarantor so they won't send him to collections, but he is a guarantor so they can send the bill to him, in so many words. I asked to speak to a supervisor, the supervisor changed the billing address to mine, and apparently noted the account the bills are to be sent to me only. In the last 8 years this has happened over and over again with the same result. The only difference is that now Paul's new wife has had secondary insurance on my boys for about 3 - 4 years. Her insurance company sends the checks directly to her, the clinic again was sending the bills to the wrong address. They don't send Paul to collections, they come after me, I have been sued a few times over bills I had no idea were there, Paul's wife never paid the bills with the checks from her insurance, this had left me with over 13k in medical debt that I reluctantly filed bankruptcy on in March. I feel like I have NO rights, I tried numerous times to work with the clinics and the agencies explaining my situation, nobody cares, they just want their money. What can I do? I really want the clinic to feel some of the pain that I have been through. All I had ever asked them to do is send ME the bill. They have never complied 100. Do I have any rights?
