We did a voluntary repo on a new car . The finance company was Wells Fargo. The car sold at auction but we were never notified as to how much it sold for and how much we needed to pay. Somewhere along the lines Midland Funding bought the debt. Never once called, wrote, no correspondence to tell us they were the ones we would have to pay. Dec 2007 we were served with court papers from SUTTEL AND ASSOCIATES notifying us they were taking us to court over the balance. We had 20 days to respond back other wise it would be a default judgement. We called them , never got a return call. The paperwork with there address was misplacedlost, I searched the internet for the address found it and sent our response back. Jan we were sent papers again saying they were seeking default judgement because we did not respond. I immediately found our copy of the letter. The address they have listed thru yahoo business search is wrong, I ended up having to go thru the washington state bar association to get there correct address as well as email. I sent an email to all there collection attorneys in the office. When I went to court there was 7 other individuals there that were having problems with SUTTELL AND ASSOCIATES and midland funding. My case was first. I explained to the judge about the emails, as well as the letters I sent, and provided her with a copy of each one that had the date, time. She asked the attorney for Suttell if they had gotten them and he stammered and said yes. She dismissed the defualt judgement

They still have not returned phone calls to set up a plan to pay off the amount left nor provided us with the amount the car sold for and we have requested it numerous times
