Thisactually happened in SpringDALE, Ohio, it just wasnt on the list at the tri-county mall at the Abercrombie Fitch Store.
I am male. I have a disability. I was sexually harassed. I was harassed about my disability. I was retaliated against after complaining about the sexual harassment by having my hours cut back on October 3, 2007. I was retaliated against when I was terminated on October 5, 2007 and when I was again terminated on October 31, 2007.
On September 17, 2007, I was sexually harassed by Ryan Ritchie, Assistant Store Manager and also was subjected to harassment regarding my disability by him as well. Ryan Ritchie stated that he never would’ve hired me had he known what my disability was going to be like. On September 22, 2007 I complained about this discrimination to Lindsay Goetsch, Store Manager-in-Training. She said that’s just the way Ryan is sometimes and that I could contact HR but that it may cause “bad blood” with Ryan. I was absent from the store from September 23-September 27, 2007 due to medical reasons and returned to work on October 3, 2007. Ryan Ritchie left my medical documentation that he had requested out on the manager’s desk for others to see. Ryan also closed the door to the manager’s office when I got there and threatened to fire me if I filed a charge against him for harassment. I complained about Ryan’s behavior to Lindsay Goetsch as well as to store manager, Jenna Hansen on October 4, 2007 but they did nothing about it. From October 3 through October 5, 2007 I was harassed continuously by Jessica Bowling, stock clerk, about my disability, after she learned about it by reading the note, left out on the desk by Ryan Ritchie. I complained about her harassment to Ryan Ritchie, then to Lindsay Goetsch and finally to Jenna Hansen, all of whom dismissed the harassment as either “nothing,” “my problem,” or “unbelievable.” Finally on October 5, 2007 after complaining about another incident of harassment by Jessica Bowling I was asked to leave the store and was terminated by Jenna Hansen, Store Manager. On October 8, 2007 I reported the harassment and the exposing of the medical information to Amy Bissmeyer, Human Resources. Amy Bissmeyer assured me that my allegations would be investigated by them and then I would have the opportunity to answer any accusations against me and learn about the remedies to my complaints when I would be contacted by regional HR Manager Amy Yocum. Amy Bissmeyer told me that Amy Yocum would contact me within the week but I did not here from her at all until October 15, 2007. At that point Amy Yocum stated that she would have a decision regarding my re-instatement the following day and would call me on October 16, 2007. I did not hear from Amy Yocum until October 23, 2007 at which time she told me that Jessica’s comments were inappropriate and that Ryan’s behavior was unprofessional but she was re-instating me at Abercrombie but requested that I remain professional around Ryan and Jessica even if it was uncomfortable for me, I agreed to do so. On October 25, 2007 Amy Yocum called me back and stated that Lindsay Goetsch had called her and claimed that I had sexually harassed her by making comments about her body. I responded by saying that the comments I made were not sexual in nature and that Lindsay had grabbed my butt before, had said I looked hot cause of my tan and curly hair and had engaged in sexually provocative and flirtacious behavior with other male employees including my friend Dane Lane. Amy Yocum would not hear my defense she said she would not change her mind she just took Lindsay’s word for it and said because Lindsay was uncomfortable with my alleged behavior I could not work there anymore and she was transferring me to the Hollister Store. I began working at the Hollister Store on October 29 , 2007. I was the only person involved in the entire situation who was out of work and without pay during the entire investigation lasting from October 5-October 29, 2007. All of the other people involved; including Jenna Hansen, Ryan Ritchie, Lindsay Goetsch, Jessica Bowling, all of them continued to work with pay during the entire period. On October 29, 2007 I was taken by an ambulance from the Hollister Store. On October 31, 2007 I was fired for “no call, no show” to work on October 30 and October 31, 2007 even though I did call in both days. I called Amy Yocum and offered to send her my phone records to prove that prove that I had called in on both days and she refused them saying that no matter what she was not going to reverse the termination.
