National Enterprise Systems

I have had an account with Sears since 1974 and have been suffering over the past couple years from financial difficulties. I had made payment arrangements and my checking account was drafted for the agreed amount monthly for 12 months. After that time, I had consulted a bankruptcy attorney because my finances were out of control and I have been trying to put the monies together to pay the attorney fee for the bankruptcy. In the meantime, my account was sent to NES. I offered to make a payment arrangement and they claimed the client will not accept any payment arrangements. I explained I did not have the funds to pay off the account, could not get the funds to pay off the account and the only option would be to make a monthly drafted payment of 100 per month. They would not take it nor would they contact SearCitibank to find out if these were acceptable terms.

They continue to call me several times a day on my cell phone. They call the office where I used to work daily. I have informed NES to stop calling my previous work number. They have left threatening messages there with the other employees regarding me contacting them. I just got off the phone with NES again and explained to them once again I have been out of work since December after attempting to make payment arrangements and offered to make another payment arrangement today but the man refused. He then questioned how I was making ends meet when I didn't have a job. I explained I had moved in with my boyfriend and the man said I needed to get the money from him and then asked how could I afford a cell phone. I told him to remove my previous office phone from the records now and when I was ready to remind him of the Fair Debt Collections Practices Act about making these type of calls to an employer, he ended the call. I just received an email from the office where I worked that they just called there and left a message...again.

What if they continue to call the office and leave harrassing messages for me there? I no longer work in that office. The company I used to work for in that location went out of business in December but we are now reestablishing business under another name but I am not working out of that location.

How do I get them to stop calling the office?
