Due to a move where service could not be used, we cancelled my daughter's DirecTv service several months into a contract ... fully aware that there was a cancellation penalty. DirecTV’s representative agreed to send an invoice and process a NOT process any charge to our debit card. This was confirmed three times with the service representative during the conversation. He was told that we would return our equipment upon receipt of the invoice and that I would pay the invoice immediately.
DirecTV processed the cancellation charge to the debit card anyway, resulting in the account to overdraw and 150 in fees before we became aware. Contact through three levels of DirecTV resulted in being told that the representative made a mistake in offering a paper invoice, that the contract says they will charge the card of record, and that they will neither refund the overdraft fees or the cancellation clause, regardless of the mistakes made by their representatives..
We contend that this practice of promising one thing in a verbal contract commitment is an act of fraud. Though we are going to file a complaint in writing, we expect no relief.
