I was recently sued by HSBC for a “supposedly” co-signed loan. They hired attorneys and took me to court and on September 28, 2007 the county court Judge denied the Summary Judgment filed against me, and ordered that the judgment is against the original borrower and owner of the automobile.
I sent the legal writ to the credit reporting agencies to have the entry removed from my report. Six week later I received a letter from HSBC asking me to prove that the loan was fraudulent.
I have spent a total of eight hours faxing, emailing and trying to contact someone via telephone to no- avail.
I have also left several messages and no one will call me back. After fighting this thing for three years I thought that with the Judges ruling it was finally over, but when I call HSBC and listen to the automatic operator and put in my social security number, I hear a message regarding how much I owe and when my next payment is due.
As a result of HSBC not removing this from my credit report, I am unable to relocate with my job that is in the accounting field due to bakground and credit checks.
Before this case was taken to court, I spent two and a half years being harassed by HSBC, the phone calls started at 7:58 and did not cease until 9:00 pm, both at home and at my place of employment even after I sent a written letter asking them not to call me, and the collectors calling were rude and cruel.
Furthermore I was manipulated and deceived into signing the loan agreement as a co-signer, and once the original borrower started missing payments I was never notified, nor did I know who the lenders were, no information was disclose to me regarding the loan agreement. Once I pulled my credit and discovered who they were and gave them my contact information, in order to get the account cleared up and out of my name, the y ceased all communication with the original borrower and pursued me only.
And the final straw came when they repossessed the car and sold it for three-thousand dollars, yet they were charging me nineteen thousand.
But my concern today is that they will not remove me from this account and it is still showing up on my credit report.
