On June 06, 2007 I received a document from Wolpoff Abramson stating it was validation that I had requested.
It did not clarify if it was in answer to my first request regarding 'Colonial Credit Corp assignee of MBNA' or the new claims made to which I had requested validation for their statement to the BBB that there was a claim in the name of 'Palisades Acquisition assignee of Colonial Credit Corp. assignee of MBNA', and another claim name of 'Palisades Acquisition assignee of MBNA'.
This validation stated that 'Colonial Credit Corp' was the Original Creditor and their address is in NJ. From my research, Colonial Credit Corp. was in Maryland with WA and Palisades Acquisition is in New Jersey at the address they gave me. The validation document was the same typed document as in their initial claim with no calculations for they amount they claim I owe and no copy of an agreement.
I had sent a complaint to the BBB of New Jersey when I received via the first letter from WA through the BBB of Maryland re Palisades claim that they had a claim against me in the name of Palisades to which I never received any notice. No response from WA or Palisades to date.
June 09, 2007, I received a notice from Wolpoff Abramson that is their request to the National Arbitration Forum to 'Amend the Claim, to reflect the Claimants name as Palisades Acquisition.' And that the account had been assigned to Palisades 'in or about March 2007'.
This request to amend is after they had made statements to the BBB of Maryland that a claim existed in the National Arbitration Forum in the name of Palisades Acquisition assignee of Colonial Credit Corp assignee of MBNA, in May 2007.
This request to amend is after I received a notice from the National Arbitration Forum that stated the claim name as Palisades assignee of MBNA, prior to a request to even change the name.
How can a request to amend be filed months after they have made claims and false allegations in reference to a claim they stated existed, when a valid claim was not filed in the name of Palisades?
Wolpoff Abramson misstated and mislead the BBB of Maryland by telling them such a claim existed in the name of Palisades and that my questions would be resolved in Arbitration.
They have just now on June 04, 2007 submitted their 'Request to amend the claim'. They could not supply a date the assignment took place, or dates of prior assignments, I was never notified of any changes after all the allegations and claims made in the name of Palisades that I have been trying to defend myself against, and now I find out they never even filed a request to amend the claim until recent. I do not see how the National Arbitration Forum can support this firm and continue this claim. These should not be acceptable practices by a firm that claims they are attorneys.
I still feel I have been mislead, deceived, had false statements made against me, has false claims made against me, and these are unfair and unconscionable acts. I also feel WA has violated the FTC acts that should protect me and have not held true to the Maryland Lawyers' Rules of Professional Conduct. I am Frustrated and confused and the Legal Status of this claim is unconscionable.
June 13, Received a document stating a clerical error, saying Colonial is not the original creditor. I want to know why the NAF has permitted them to continue with this claim. This is unprofessional conduct.
