Dear Madam or Sir:
My intention is to describe to the best of my knowledge when referring to dates and events what has happened with me and my vehicle I purchased and financed through a company call Credit Acceptance Corp. ( P.O. Box 513 Southfield, MI 48037 ) and why I would like to take action against this company. Sometime in July of 2005 I received a letter in the mail from the mentioned company stating that I was approved to get financed with their company for a vehicle and the letter referred me to a dealership that was in my area that I could go and pick out and finance a vehicle. The dealer they referred me to was R H Auto Sales ( 5873 Camp Rd. Hamburgh, NY 14075 ). I went to the auto dealer to see my options and picked out a 2000 Impala. I had a vehicle to trade in on the down payment which was a 92 Geo Tracker. The dealer told me I would need additional money for the down payment so I applied for a retirement loan through my employer that same day. It took three weeks to receive the funds. I had traded the 92 Tracker in on the first day I went down there. The dealer had asked me if I would like new plates or to keep my old ones, I specifically told him I needed new plates seeing how I traded in the 92 tracker almost a month prior too when I would be getting the new vehicle and that I would be canceling the insurance on the Tracker. Well in or about Sept. 1st I received the 2000 Impala. A month later I went to renew my drivers license only to find that my license was suspended due too lapse of insurance on a 92 Tracker that I didn’t even own anymore. The dealer charged me for new plates and just took my old plates and put them on the 2000 Impala. My license was suspended till April of the following year. The vehicle was picked up by Credit Acceptance sometime in January of 06 due to late payment I caught up the payment and settled all the fees. Sometime in April or May of 06 a repossession company called me and I talked to a guy that told me he needed to pick up the car from me due to late payments again and I told him he had already picked up the vehicle in January of 06 and that it was being stored there since then and that I could not pick it up because I could not register the vehicle cause Credit Acceptance had not given me a title yet. We then talked for about 30 min and in that time he had told me that he thought that Credit Acceptance had sold the car out from under me even though I was still making payments and the vehicle was mine because the car was not on his lot like Credit Acceptance had told me it was. I was never able to confirm if they had sold the vehicle or not. From about January of 2006 I started to wonder where my Title to the Impala was because of the fact that I now needed it to register the car because nothing went through on the purchase. Also the dealer called me sometime in January of 06 to inform me that nothing went through the DMV because my license was suspended. I informed him that it was his fault that this was going on and that my license had been suspended because of him. He then stated that he was sorry and that if I gave him an additional 300 dollars that he could “get around the DMV”. I told him I wasn’t going to give him another cent. I called Credit Acceptance to inform them what the dealer had said and what was going on and they said they would call me back after they had talked to the dealer and found out what was going on. They called me back and the representative said “The guy has a few screws loose upstairs” and that she was going to try and take care of the issues but nothing ever happened. I called Credit Acceptance Corp at least once a week from January of 06 till June of 06. Every time I called the told me that the title should have gotten to me already and that they were going to send a new title out to me and I never received a title. I got hung up on several times in this process and no one could give me an answer to why I had not received a title to the car. In that time I had to pay Credit Acceptance several storage fees for them storing my vehicle that I couldn’t get out because they didn’t send me a title and I could not register it to drive it. I was told over the phone by one of their representatives that “You can just go pick up the car, it doesn’t matter if you don’t have a registration or plates on the vehicle, just tell the police if you get pulled over that you are just picking the vehicle up from a repossession lot” I of course did not do this because it is illegal to drive without plates and the car would surely be impounded and I would be in more trouble than I already was. I paid every monthly payment from September of 05 till June of 06 including the storage and repossession fees they tacked on even though it was their fault I could not pick the car up. In July of 06 I contacted Credit Acceptance one last time to inform them that I would not be paying one more cent on the vehicle till I received the title to the vehicle and that if I didn’t receive the title I would be taking legal action against the company. They told me to do what I have to do so I am here writing this letter. I lost my license to drive for 8 months and had too pay fines with the DMV, lost a large amount of hours from my job due too not having a vehicle to drive to and from work, I paid every bill for the vehicle for 10 months including storage fees and repossession fees and this has all damaged my credit worse than it already was. None of this was in any way my fault and I have lost so much time and money because of this. Please help me in this situation for I have lost so much and don’t know what else to do or where else to go. Thank you for your time.
