Nature of this Complaint: On October 24, 2005 I traded a 2004 BMW M3 convertible for a 2006 BMW M5. I put money down on this vehicle a few months earlier. It was reported by the dealer that I was getting the first vehicle in America, that later I found out was untrue. The day the car arrived I went to the dealer to get my money back, because I was having financial problems. As the day went on I was convinced to purchase the vehicle by Orson Guyton (the sales manager). I knew that by purchasing the vehicle I would be able to sell it for a profit. Many dealers and owners were selling the right to purchase a spot in line to be the next to obtain the 2006 M5. People were making 15-25,000 dollars over sticker. I knew by selling the vehicle I could make the money that I needed, and by owning the first vehicle almost assured it. The purchasing of this vehicle was to be on my terms. It was required that I put more money down, which I told the dealer I had no more to give. I ended up giving them 2 checks, one that they could cash right away and one that they would hold until I told them the funds were available in my account, which they agreed to do. They also told me that BMW said that taxes had to be written into the contract because of the price of the vehicle. I did not agree to this because I wanted to sell the vehicle and I knew this would delay the process a few more days and time was of the essence. They also used the address off my drivers license for the paperwork, which I had told them was inaccurate that I no longer lived at that address and and supplied them with the correct address. Texanne (finance manager) told me not to worry about it. That evening I was told that they would title and obtain plates for the vehicle per the contract with BMW. Over thirty-five days had passed and I still had not gotten one piece of paperwork or plates. They also bounced the hold check through my account twice. I went back to the dealer as I had done many times in the past weeks. I sat down in the finance office and was told (by Texanne) once I paid for the bad check I wrote that they would give me my paperwork(isn’t that blackmail?). I called my father on the phone from the finance office and received permission to use his credit card. Once the credit card cleared they gave me my paperwork, no plates, a title that was not in my name and a useless check written to the DMV in the state where I used to live. I felt so screwed because I was getting stuck with a car that was quickly becoming more available to the public on a daily basis, a car I still did not have the title to, and could not pay the taxes because everything was written to a county in Florida that I no longer lived in. This was a car they (the dealer) were supposed to get titled and plated per their agreement with BMW. Now to top it off, the first payment is due and I can not afford it, and I still can not sell it. They were nice enough to give me a second temporary tag, which is I do believe illegal for them to do. They also had me sign a new contract reporting problems with the old one. Finally I called BMW North America and they got involved. Sandy Finan (BMW North America) reported that West County BMW dropped the ball and she would help. Now it is another two months later and I was directed to take the title back to the dealer, so that they can title the vehicle in my name. By this time I still do not own the vehicle, I have an unusable tax check and useless paperwork, and now a mark on my credit report for being thirty days late because I refuse to pay for a car I do not own,(as reported by Sandy that I should not drive the vehicle because I do not own it and that I should take the car back to the dealer and set the keys on the counter and walk away. What am I supposed to do, lose my money and drive my Nikes now that my credit is bad?) They also cashed the hold check, so at this point they have more money than they should, plus I have to cover the bounce check fees on a check they agreed to hold until I had the funds available. After approximately 100 days I went to BMW and gave them more money so they could pay the taxes and register the vehicle in Missouri, because I needed a car to drive. After about 120 days they sent the tax money back to BMW to cover a payment. They also had me pay the late fees. The contract has me paying for maintenance which was advertised and reported to me to be covered for free which I believe is false advertising. The contractual numbers do not add up as there is almost 1000.00 dollars not accounted for. I have a different contract than the contract that BMW West County submitted to BMW Financial Services. I had no clue what I was signing, as they would have a stack of papers in their hand when they came to me to sign and always had the sheet I was signing covered up and just instructed me to sign. I was signing on many different dates and they would illegally back date the paperwork. They played a trust game that they abused. There is a lot more, but this is the big stuff. They have used their position to take advantage and ruin me. I flip for a living, I own a real estate company that flips houses and occasionally cars for the right deal. BMW West County knew of my intent to sell the vehicle and use the profit money down on another vehicle so that I could afford it. I can not afford this payment real or imagined and now my credit is damaged by no fault of my own. This is very bad business. Blackmail, contractual default, illegal contracts, false advertising, playing with the contractual numbers after the sale and back dating, not receiving a contract until 35 days after sale, a contract that is not the same as what was submitted to BMW Financial Services, putting my financed money in their interest baring account that was never used for my taxes, taxes I paid for...and on and on....I wish I could continue but I am really getting frustrated the longer that I rehash this in my mind.
