Currently managers at EBGamesGamestop--now the largest and only SOLE retailer of video games and video game consoles nationally--- are misclasssified under FLSA regulations. Sadly the written job description vs the reality of the job are 2 different things; managers are salaried to avoid paying over time. They are required to work a 44 hour work week, if they fail to they can be fired. They are supposed to supervise several employees--in reality they may work WITH 1 other , or possibly 2 other employees at any given time. The day to day duties of these managers are no different from any other employee in the store (Running registers, helping customers, cleaning the store,dealing with shipments, etc.).The only difference between these managers and the non salaried is the company treats them with an 'available 247' attitude, places a false set of responsibilities of 'managing' the stores--claiming stock settingschedulingand other managerial duties are large parts to the job, when in fact they are handled by the corporate office or are reduced to annual comments on employee performace that is 70 based on store numerical performance. As they are an 'at will' employer, termination is a reality that occurs regularly for those who fail to follow company policies.
