I worked for 'The Pittston Coal Company' over 23 years. 16 years UMWA and 8 years salary I become totally disabled in 1997. I was fully vested and had a Life Annuity. I started drawing my pension in 1998 of 1,751.66 a month. I had been drawing a long term disability and when I was awarded my pension Pittston said I had to pay back the LTD 18,000.00 and to date I have made payments and I still owe 14,000.00
In 2003 The Pittston Coal Company sold out to Brinks. In August 2005 I got a letter from Brinks saying that Pittston Coal had made a calculation error and Brinks reduced my pension by 518.00 a month and from that 176.00 a month was for recoup overpay of 32,000.00. Brinks said the plan states a Nonduplication of benefits. I have a pension denial letter from the UMWA and to date I haven't got any money from the UMWA.
Brinks said the 176.00 of the a month recoup would be for the next 29 years.
Now my pension is 1,233.83 a month. I've had five back surgeries and still in chronic pain. I worked hard and have earn my pension and I have everything showing that I was fully vested. I am making payments on doctor bills.
