More May Join In Great Escape Illness Suit
As many as 600 people may take part in a class action lawsuit against the Great Escape Lodge and Indoor Water Park.
Two law firms represent about 130 people who say their visit to the water park last year made them sick with a gastrointestinal illness. A ruling by Warren County state Supreme Court Justice David Krogmann will allow the lawyers to reach out to hundreds more potential plaintiffs.
In March 2008, the state Department of Health investigated the Six Flags Great Escape Lodge after people fell ill with severe vomiting and diarrhea. The DOH later determined Norwalk virus was the cause, a bug that can be spread by contaminated food, surfaces or direct contact with an infected person. It is highly contagious, but for healthy people it is not a serious infection.
George Szary, a lawyer for DeGraff, Foy & Kunz, which is working with the Dreyer Boyajian firm, put what he called a rough estimate on the potential damages in the case at $6 million.
Krogmann's ruling applies to guests who became ill at the resort or within 72 hours after their visit and were in communication with DOH. The court will oversee the wording of the notification and how potential plaintiffs are contacted. The next step for the lawyers is to settle the exact number of people who will be included in the suit.
