Connecticut Consumers Claim Peter Roberts & Associates Sought Illegal Collection Fees
A statewide class action has been filed in Connecticut against collection specialist, Peter Roberts and Associates, Inc. The action is brought on behalf of all Connecticut residents from whom Roberts attempted to collect allegedly illegal collection fees in connection with an attempt to collect an outstanding debt other than a student loan. The action is brought under the federal Fair Debt Collection Practices Act and is based upon Connecticut consumer laws. The consumers are seeking compensatory damages as well as injunctive and declaratory relief.
According to consumers, Roberts has been charging fees in excess of the legal limit during collection attempts. The consumers allege that Roberts charges fees in excess of 15% of the total value of the debt under collection. This, according to consumers violates Connecticut state law and the Fair Debt Collection Practices Act. In addition, consumers allege that Roberts does not itemize collection statements, misleading and deceiving consumers by not providing an accurate accounting of the original debt, fees and interest. Consumers allege that this is a longstanding tradition of Roberts' and that the potential class is quite numerous as a result.
