Orkin's Parent Company, Rollins, To Appeal Class Action Status
Superior Court Judge J. Stephen Schuster granted class-action status to a suit against Orkin parent Rollins Inc. that alleges the company failed to uphold its contract to protect homes from termite damage through reinspections and retreatments.
Ernest W. Warren and Dolores W. Warren of Marietta, Ga., first filed their suit in 2001. They are represented by Barnes Law Group LLC of Marietta. The suit alleges Atlanta-based Orkin Inc. "concealed the lack of proper reinspections/retreatments through a pattern of forgery and fraud" and did the same with other customers in Georgia. The couple claims Orkin "knew of a long-running, widespread problem of its employees failing to reinspect and retreat customers' homes."
The Warrens also claim Orkin's alleged failures led to severe termite damage to their home. They seek to recover monetary damages and an injunction to prevent Orkin from alleged false advertising. But the couple is not seeking class certification for their property damage.
The lawsuit covers any Orkin customer in Georgia who bought or renewed a standard termite contract after Oct. 16, 1995.
