A class action lawsuit has been filed in the Western District Court of New York against Niagara Frontier Transportation Authority (NFTA) for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek a declaratory judgment, unpaid overtime, damages, attorney's fees and costs of the litigation.

Specifically, the complaint alleges that Donald Notaro was a firefighter for the NFTA. He was required to work an eight (8) hour day schedule consisting of two (2) – ten (10) hour day shifts, and two (2) –fourteen (14) hour night shifts and four (4) days off. He was not paid for overtime compensation when he worked over forty (40) hours per week as required by the FLSA.
