Then 10 years old, Hess had been using Listerine Agent Cool Blue. It's designed to turn plaque blue so kids know exactly where to brush. But in April 2007, Johnson & Johnson recalled the product after tests showed it was contaminated with bacteria.
Smith is suing Johnson & Johnson's subsidiary company, McNeil-PPC, Inc. Hess' case leads up the class action suit, which seeks more than $5 million for those who say they got sick.
This particular product is not an antiseptic product. Listerine Agent Cool Blue is now back on store shelves.
