California Red Light Photo Enforcement Suffers Blow When Two Related Class Actions are Certified

The classes have been certified in two related class actions filed against Lockheed Martin, IMS; ACS State and Local Solutions, Inc.; Affiliated Computer Services, Inc.; and Del Mar Ventures, LLC (formerly known as U.S. Public Technologies LLC) on behalf of persons who have received traffic citations in 14 California cities and the county of Los Angeles. The actions seek a return of the amounts paid as fines, penalties, bail and attorneys' fees spent because of the issuance of the citations, plus unspecified punitive damages.

The actions allege that the red light photo enforcement systems operated in certain cities and the County of Los Angeles are illegal because they are operated by a private, for-profit corporation instead of government agencies and that corporation is paid if money is collected from the red light ticket. The actions involve the systems operated in the cities of Beverly Hills, Cupertino, El Cajon, Imperial Beach, Indian Wells, Los Angeles, Oxnard, Poway, Redwood City, Sacramento, San Diego, San Francisco, Santa Rosa, and West Hollywood, as well as in Los Angeles County.
