An environmental class action may be the proper remedy when a company, or a number of companies, release a pollutant into the environment that harms a group of people. Sometimes the pollutant is released over a long period of time, perhaps in the course of the company's manufacturing business. Other times the pollutant is a one-time release, perhaps following a fire, explosion or other accident. In either case the people who live or work in the affected area may seek compensation through a class action for environmental injury.
Another type of environmental class action can arise when a group of employees at a particular company is affected by a toxic substance that they encounter during their work. State workers' compensation laws can make it difficult to bring an action against the employer, but sometimes it may be possible, and when it's not possible there may be other responsible parties, such as the firms who supplied the toxic substances, or the company that formerly operated the business.
