Insurance Class Actions
Lawsuits Against Insurance Companies
Class actions against insurance companies may involve any type of insurance, especially auto, life, health, or mortgage insurance. The claims asserted in the class actions depend on the type of insurance involved.
Thus, where a class action makes a claim under a motor vehicle insurance policy, a number of class actions seek recovery for the use of replacement, rather than OEM (original equipment manufacturer), parts, or for the diminished value of vehicles that have been repaired after being involved in an accident. Of course, a wide variety of other claims may be asserted in an auto insurance class action.
Class actions claiming that the insurance company miscalculated the premiums under the policy, or put the policy into effect on the wrong date, are also common, and may arise under any type of insurance policy.
In recent years, a number of class actions have been brought against companies that sold burial or industrial life insurance policies seeking recovery for racially discriminatory premiums that were charged African-American policyholders.
