Childers, et al v Hebron Auto Sales

Used Car Owners File Lawsuit Against Hebron Auto Sales

Case ID: 4647
Category: Automotive

Last Update: 02/07/2006
Country:

Vince and Jessica Childers of Hebron, Michigan allege that they, along with at least 59 other customers, purchased used automobiles from Hebron Auto Sales for which the dealership did not have title. The Childerses allege that Hebron Auto Sales kept the money but did not give the car titles to the purchasers.

Also named in the complaint is Michigan-based Credit Acceptance Corporation (CAC), who the plaintiffs say participated in what they call a "car-kiting" scheme. The Childerses allege that CAC assisted in the scheme by making cash advances on vehicles prior to Hebron Auto Sales holding valid title.

Hebron Auto Sales closed its three locations in Richwood, Colerain Township and Middletown late 2005.

The lawsuit asks for customers' vehicle titles to be cleared by the defendants, as well as unspecified punitive and incidental damages.
