Marriott Workers Allowed To File Claim In Class Action Suit
Those who were hourly employees at the Desert Springs, a JW Marriott Resort and Spa, and Renaissance Esmeralda Resort and Spa over a five-year period should notify a claims administrator assigned to oversight of settlement proceeds in the case.
The lawsuit, filed initially by plaintiff Huyen-Tram Nguyen, a poolside server, alleges that the Marriott properties did not pay employees for missed meal periods or rest breaks. According to the settlement, Marriott does not believe the claims hold merit.
About 760 current and former employees are estimated to be eligible to sign on to the lawsuit, Emge said. Whatever is awarded will be split among those who file with the claim.
The money will be allocated based on the number of hours each plaintiff worked in relation to the total hours worked by the entire class.
A final approval hearing is scheduled with the U.S. District Courts Central District division in Riverside. Plaintiffs could receive payments by November or December, Emge said.
