Pilots Sue Continental Airlines For Discrimination
A class action lawsuit has been filed against Continental Airlines by some of its pilots, claiming that the company is discriminating against them because they are military and National Guard reservists.
A United States Marine pilot turned lawyer, Lawler is taking on airline giant Continental. Himself a Marine reservist, Lawler said the company is discriminating against others like him, men and women serving their country in a reservist or national guard capacity while maintaining a civilian job.
The suit claims Continental broke federal law by denying jobs, promotions and benefits to people serving in the military or National Guard. Four pilots have been named in the suit. Three of them currently work for the company and the other said he was denied a job with Continental because of his military commitments. He now flies for another airline.
Since the suit was filed in July, Continental has filed a motion to have the case moved from San Diego to Houston, where the company is based.
A similar case was filed by three pilots against American Airlines in 2004. That case was settled in 2008. American was ultimately ordered to give vacation and sick-leave benefits to pilots in the reserve and Guard as if they hadn't missed time due to military commitments.
