Franchisees Notified of Class Action Against Mail Boxes Etc.

Notices have been sent out to approximately 3,000 franchisees of Mail Boxes Etc. and The UPS Store, giving them the option to be a part of a national class action lawsuit against the franchisor or to opt out. According to a press release dated November 13, 2009, the complaint charges Boeing and certain of its officers and directors with violations of the Securities Exchange Act of 1934. Boeing is involved in the design, development, manufacture, sale and support of military aircraft, satellites, missile defense, human space flight, launch systems and services, and commercial jetliners, including the Dreamliner 787 (787), Boeings principal next generation commercial airplane, which has been eagerly awaited by the commercial airline market and the financial markets since it was first announced in 2004.

Stockholders File Lawsuit Against VeraSun Energy Corp.

According to a press release dated November 10, 2009, The complaint alleges that, throughout the Class Period, defendants failed to disclose material adverse facts about the Companys true financial condition, business and prospects. Specifically, the complaint alleges that defendants failed to disclose the following adverse facts, among others: (i) VeraSun was, in part, a speculative commodities trader in addition to an ethanol producer; (ii) VeraSun engaged in speculative and risky derivate transactions that exposed the Company to substantial financial and liquidity risk; (iii) VeraSun experienced substantial loses on speculative derivative transactions causing margin pressures on the Company; (iv) as a result of margin pressures from bad speculative derivative transactions, the Company sold out of a large short position in corn and incurred substantial losses; (v) the Company entered into highly risky accumulator contracts that obligated VeraSun to purchase increasing amounts of corn after the price of corn fell in price per bushel; and (vi) VeraSuns financial condition and especially its liquidity were negatively impacted as a result of speculative commodity transactions, ultimately causing the Company to file for bankruptcy.

According to a press release dated Novemer 10, 2009, Hemispherx is a biopharmaceutical company engaged in the clinical development, manufacture, marketing and distribution of new drug therapies based on natural immune system enhancing technologies for the treatment of viral and immune-based chronic disorders. The Company's products include Ampligen, an experimental drug undergoing clinical development for the treatment of chronic fatigue syndrome.

Proshares Trust : ProShares UltraShort S&P 500 Fund

According to a press release dated November 10, 2009, ProShares sells its Ultra and UltraShort ETFs as simple directional plays. As marketed by ProShares, Ultra ETFs are designed to go up when markets go up; UltraShort ETFs are designed to go up when markets go down. The SDS Fund is one of ProShares UltraShort ETFs. The SDS Fund seeks investment results that correspond twice (200%) the inverse (opposite) of the daily performance of the S&P 500 Index. Accordingly, the SDS Fund is supposed to deliver double the inverse of the return of the S&P 500 Index, which increased approximately six percent from January 1, 2009 through July 30, 2009. In other words, the SDS Fund should have declined by twelve percent during this period. However, the SDS Fund fell approximately 29 percent during this period.
