Purchasers of Chemicals Used to Make Foam Sue Bayer AG over Price Fixing
A class action lawsuit has been filed in the District Court of New Jersey against Bayer AG, a pharmaceutical company based in Germany with offices nationwide, for price fixing. Class members seek triple damages, attorney's fees, and the costs of the litigation.
Specifically, the complaint alleges the defendants manufactured, sold and distributed Polyether Polyols, MDIs, and TDIs (used for the making of foam products) throughout the United States and increased the prices of the items in 2000, 2001, 2002 and 2003 through conspiracy where they fixed, raised, stabilized, and maintained artificially high levels.
More specifically, the complaint alleges that the defendants agreed to charge prices at certain levels, and otherwise to fix, increase, maintain or stabilize prices of Polyether Polyols, MDI and TDI in the United States and sold them at the agreed upon prices.
Class members include all persons who purchased Polyether Polyols, MDI or TDI in the United States directly from any of the defendants or their subsidiaries or affiliates from November 2000 to present.
