Wireless Phone Subscribers v AT&T Wireless Services, Inc.

Wireless Phone Users Call AT&T to Task For Questionable Charges
A class action lawsuit has been filed against AT&T Wireless Services, Inc. on behalf of wireless phone subscribers who requested termination of their wireless accounts and were then charged an "adjustment" or other fees for services after the effective date of the termination.
The lawsuit alleges that AT&T Wireless routinely charged terminating subscribers an "adjustment" or "monthly service charge" equal to the amount of the pro-rata credit the customer received for the un-used balance of the monthly fee after the date of termination. The plaintiffs allege that this practice violated both AT&T's service agreements and FCC rules, entitling plaintiffs to damages.
Plaintiffs seek actual damages as well as statutory and punitive damages and an order enjoining AT&T Wireless from engaging in the alleged practices.
