Other Consumer Products Cases of InterestAngry iPod Nano owners have filed a class action lawsuit in the U.S. District Court in San Jose, California, against Apple Computer, Inc. The lawsuit, filed by attorneys in Seattle in Columbus, Ohio, on behalf of all Nano owners, charges that the iPod Nano's LCD screen is too easily scratched. CCC Information Services Inc., a subsidiary of CCC Information Services Group Inc. announced July 13, 2005 it and 15 of its customers signed a settlement agreement with the plaintiffs in various class action suits pending in Madison County, Illinois. The consolidated suits relate to the valuation of vehicles that have been declared total losses by insurers. A proposed class action filed in Los Angeles federal court claims 300,000 lawyers and law students have been ripped off by the popular BAR/BRI bar review courses. The suit alleges co-defendants BAR/BRI and test-preparation giant Kaplan agreed to "a per se illegal market division." Under the alleged pact, BAR/BRI backed out of the LSAT preparation business and Kaplan agreed not to enter the bar-review course market. A class action lawsuit filed in Madison County Circuit Court will now be arbitrated, as a result of an appellate court decision. The appeals court has voted to Verizon's motion to compel arbitration and stay judicial proceedings. The suit arises out of a dispute over cancellation fees between Verizon and named plaintiff Dawn Zobrist. When Zobrist became a Verizon customer in July 2001, she entered into a two-year service plan. Zobrist cancelled service in March 2002, and Verizon billed her $175 for a cancellation penalty which Zobrist claims she paid "under protest." The suit seeks financial and other damages. New York State Attorney General Eliot Spitzer filed a $250 million fraud suit against H&R Block Inc., accusing the nation's largest tax preparation service of fraudulently pushing clients to invest their tax refunds in retirement accounts that had high fees and low returns. The lawsuit is on behalf of customers who have opened the Express IRA accounts. The class has been certified in a nationwide lawsuit filed against Trex Company, Inc., on behalf of persons who purchased Trex decking materials between 1992 and 2004. The action alleges that Trex is defective and does not meet its marketing and warranty assertions, in violation of state consumer protection laws.
