On May 5, 2005 the Court issued a permanent injunction against Creaghan A. Harry, who does business as Hitech Marketing, Scientific Life Nutrition, and Rejuvenation Health Corporation, by the Federal Trade Commission, on behalf of persons who have purchased bogus “human growth hormone” products over the Internet. The action alleged that Harry is responsible for millions of illegal spam email messages, all of which violate the FTC Act and the Controlling the Assault of Non-Solicited Pronography and Marketing Act of 2003 (CAN-SPAM Act).
 
Kahn Gauthier Swick is investigating possible legal actions against Boehringer Ingelheim Pharmaceuticals, Inc., the German pharmaceutical and chemical conglomerate, after it issued new warnings regarding its HIV drug Nevirapine (trade name Viramune) in February 2004. The new warnings indicate that the drug can cause severe, life-threatening toxicity in patients’ livers, possibly culminating in complete hepatic failure. These events are often associated with a rash that can sometimes become life-threatening in and of itself. The parties have reached a $50 million settlement in an administrative action filed against pharmaceutical company Bristol-Myers Squibb Company (NYSE:BMY) filed by the U.S. Securities and Exchange Commission. The action alleged that, from the first quarter of 2000 through the fourth quarter of 2001, Bristol-Myers engaged in a fraudulent scheme to overstate its sales and earnings in order to create the false appearance that the company had met or exceeded financial projections set by its officers and earnings estimates established by Wall Street securities analysts. A class action lawsuit has been filed on behalf of uninsured patients who received and were billed for medical care by any hospital within the Seattle based Providence Health Systems network of hospitals. The suit contends that Providence billed its uninsured patients at rates far in excess of the rates employed for insured patients and that this practice was and is both discriminatory and illegal.
 
The Justice Department filed a class-action lawsuit against American Airlines, claiming the carrier illegally denied benefits to pilots while they were serving in National Guard and reserve units.
 
A class action has been filed against pharmaceutical company Biovail Corporation (NYSE: BVF) and certain of its officers and directors by stockholders who purchased the company's common stock between May 17, 2002, and October 30, 2003. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
