Other Automotive Cases of InterestCamden, New Jersey Foulke Management Corporation, which operates a number of car dealerships, has engaged in a series of bait-and-switch sales practices. The practices were so widespread and frequent that a couple filed a class action lawsuit against Foulke. The class has been certified in an action filed against Volkswagen of America, Inc. on behalf of Florida owners of 1999-2002 VW Jettas, who allege that their front end spoilers are poorly designed, so that they catch on parking lot curbs and easily tear off. The action seeks compensatory damages for those owners who have had to pay for repairs, and a remedial fix for those owners who have had no problems. Persons eligible to take part in the action should contact the attorneys for the class for more information. A national class action has been filed in South Carolina against the Kubota Tractor Company. The action is brought on behalf of all U.S. residents or entities (except those residing in Louisiana) who have purchased a Kubota M-8200 or M-9000 tractor within 3 years of February 3, 2004. The action alleges that these tractors contain defective clutch discs and seeks the rescission of the sales of the defective tractors, or in the alternative, the repair and replacement of the clutch discs at no charge to the class members. The action is brought under the Uniform Commercial Code, which is recognized in all states except Louisiana and the laws of negligence. A federal judge in Oklahoma will soon decide whether to grant class action status to lawsuits that claim General Motors (GM) sold pickups and sport utility vehicles with defective engines, the attorney representing car owners.
The lawsuit says that GM produced as many as 800,000 pickups and SUVs between 1999 and 2002 with a noisy defect referred to as piston slap, according to an attorney for the plaintiffs. A class action has been filed against Shell Oil Company, Motiva Enterprises, LLC, and several other affiliated companies on behalf of persons who purchased sulfur-tainted gasoline from Florida gas stations that were supplied by Shell Oil or Motiva during May 2004. The gasoline causes fuel gauges to stop functioning, and may cause other unknown problems. Tens of thousands of Florida motorists will get compensation under a $50 million class-action settlement approved over the alleged illegal purchase of their motor vehicle records by a bank from the state government. |
