The parties have reached a $20 million settlement in an action filed against Midwestern insurance company Central States Health and Life Company of Omaha on behalf of cancer patients and their families who alleged that the company refused to pay for certain treatments allegedly covered under cancer insurance policies it sold, in violation of its contracts with the patients. Several class actions have been filed against biopharmaceutical research company Allos Therapeutics, Inc., (Nasdaq:ALTH) and certain of its officers and directors by stockholders who purchased the company's common stock between April 23, 2003, and April 29, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The parties have reached a tentative settlement apparently valued at more than $13 million in a class-action filed against the Kentucky Department for Medicaid Services and the Kentucky State Cabinet for Health Services on behalf of thousands of Kentucky residents who lost their eligibility for nursing home or in-home care because of stricter rules that were enacted in April 2003. Ten women filed a lawsuit against Johnson & Johnson and its subsidiary Ortho McNeil on July 25, 2005, claiming the birth control device the company manufactures caused them to suffer strokes and blood clots.
Lawyers in Seattle, Washington filed a lawsuit against the New York Office of State Parks on behalf of over 3,200 people who became ill with Cryptosporidiosis after visiting the Sprayground at Seneca Lake State Park in July and August, 2005. The notice was filed on behalf of Tricia Van Putte and her two young children, who are the named plaintiffs in the class action lawsuit, and who became ill with Cryptosporidium infections after visiting the Sprayground. A company is caught engaging in anticompetitive behavior, either state or federal antitrust law may be used against it. A class action has been filed against Medco Health Solutions, Inc. and Merck & Company on behalf of California pharmacists, who allege that the companies engaged in anticompetitive behavior in violation of state antitrust law. |
