Other Drugs / Medical Cases of InterestNumerous drug companies have recently been charged with requesting fraudulent patents. A class action has been filed against Purdue Pharma, LP, the manufacturer of the popular painkiller, OxyContin, on the behalf of purchasers who allege that the company fraudulently secured patents on the drug in an effort to stave off cheaper generic competition. InterMune Inc., a biopharmaceutical company based out of California, has agreed to pay the government $36.9 million to resolve criminal charges and civil liabilities in connection with allegations of illegally promoting Actimmune for treatment of idiopathic pulmonary fibrosis (IPF). Several class actions have been filed against pharmaceuticals and healthcare supply wholesaler D&K Healthcare Resources, Inc. (Nasdaq:DKHR) and certain of its officers and directors by stockholders who purchased the company's common stock between April 23, 2001, and September 16, 2002. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. Sutter Health settled a class-action lawsuit related to its billing of uninsured patients, under which the system agrees to abide by its charity-care policy, adopted in March 2006, for at least three more years. A woman filed a proposed class-action lawsuit in Los Angeles against writer James Frey over his controversial memoir about his recovery from drug and alcohol abuse, court papers showed.
Several class actions have been filed against biotechnology company Biopure Corporation (Nasdaq:BPUR) and certain of its officers and directors by stockholders who purchased the company's common stock between March 17, 2003, and December 24, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations regarding Biopure’s blood replacement product to the market over this time period, thereby artificially inflating the price of the company's securities. |
