Other Drugs / Medical Cases of InterestA class action has been filed against Lakeridge Health Corporation and the Brooklin Medical Centre, Inc., on behalf of all persons who were negligently exposed to tuberculosis by their contact with a tuberculosis carrier at any of the Ontario, Canada, facilities between February 1 and October 23, 2003, and who were later contacted by any public health authority or the defendants and advised that they might have contracted TB, or who actually contracted the disease. The action seeks $200 million in compensatory damages, and $20 million and punitive damages. A class action lawsuit has been filed in US District Court against Arkansas based Beverly Enterprises, Inc. d/b/a Beverly Healthcare The case involves violations of contract law. No additional information about the substance of the allegations is available at this time. A class action complaint alleging Gateway Regional Medical Center in Granite City, Illinois inflated charges for uninsured patients will be heard on the hospital's motion to dismiss on Sept. 26. Circuit Judge Daniel Stack will hear the case in place of the retired Judge Philip Kardis.
Kimberly Chronister, Lisa Golino, Julia Holman, Linda Hughes, and Robert Orasco accuse the hospital of charging unfair and unreasonable prices for medical care. The plaintiffs all reside in Illinois. Kahn Gauthier Swick is investigating claims that the Tulane University Willed Body Program, and possibly the Willed Body Program at LSU-Shreveport, has allowed human remains under its care to be treated disrespectfully, and in a manner that would horrify the casual onlooker. The parties have reached a tentative $4.5 million settlement in several actions filed against PHP Healthcare Corporation and certain of its officers and directors by stockholders who purchased the company's common stock between July 27, 1995, and November 19, 1998. Persons eligible to participate in the settlement must file a proof of claim postmarked no later than May 13, 2004. An administrative proceeding has been filed against Smart Inventions, Inc., a California-based direct response TV company, and its Chief Operating Officer, Jon D. Nokes, by the Federal Trade Commission on behalf of persons who purchased “Biotape,” a tape-like substance promoted to treat or cure severe pain. The action alleges that there is no substantial evidence that the product relieves pain, and that the advertisements violate the FTC Act because they are false and misleading. |
