A class action has been filed against drug manufacturer Impax Laboratories, Inc. (Nasdaq:IPXL) and certain of its officers and directors by stockholders who purchased the company’s common stock between May 5, 2004 and November 3, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
A class-action lawsuit recently filed alleges that Medicare has failed to properly enroll millions of low-income seniors and disabled beneficiaries into its new prescription drug plan. The suit, filed in Oakland on behalf of three women and two senior-advocacy groups, also alleges that some low-income beneficiaries eligible for a subsidy were not properly notified about it or not receiving it. As a result of the problems, many seniors and others who qualify for the program are going without critical medication, said lead attorney Jeanne Finberg of the National Senior Citizens Law Center.
 
Asbestos-related work injuries can be devastating. The parties have reached a tentative $375 million settlement in several class actions filed against Travelers Property Casualty Corporation on behalf of persons exposed to asbestos and their families, who allege that the insurer engaged in unfair trade practices by inappropriately handling and settling asbestos claims.
 
The issue of corporate health plan prescription contraceptive coverage is growing quickly. A class action has been filed against DaimlerChrysler Corporation on behalf of women employees who allege that the company discriminated against them by failing to include prescription contraceptives in its health plan coverage in violation of federal civil rights laws.
 
The FDA directed Eli Lilly and Company, the manufacturer of Strattera (atomoxetine), to revise the prescribing information to include a boxed warning and additional warning statements that alert health care providers of an increased risk of suicidal thinking in children and adolescents being treated with this medication. FDA also informed Lilly that a Patient Medication Guide (MedGuide) should be provided to patients when Strattera is dispensed. The MedGuide advises patients of the risks associated with and precautions that can be taken when Strattera is dispensed.
