The action is brought on behalf of all current and former "field supervisors", who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A Charlottesville man has filed a federal class-action lawsuit on behalf of himself and other local black men asked by police to submit to DNA testing in the hunt for the serial rapist that has been forensically linked to at least seven attacks between 1997 and 2004.
A statewide class action has been filed in New York against collection specialists, Cohen & Slamowitz. The action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief. Federal credit and banking laws prohibit credit providers from discriminating based on ethnicity, national origin, or race. The parties have reached a tentative settlement in a nationwide action filed against General Motors Acceptance Corporation on behalf of African Americans who allege that, as a result of company policies, dealers routinely charged black consumers higher interest rates on auto loans than whites with similar financial histories in violation of the federal Equal Credit Opportunity Act. Persons eligible to take part in the settlement should contact attorneys for the class for more information. A class action spanning Pennsylvania, Georgia and New Jersey was filed in Pennsylvania against the law firm of Lawrence A. Hecker, P.A.. The action was brought on behalf of all consumers residing in the three states who received "form" type collection letters from Heckler. The action was brought under the Fair Debt Collection Practices Act and sought statutory damages as well as injunctive and declaratory relief. Federal civil rights law has as its goal equalization of the employment playing field so that all people have a fair chance at advancement. The parties have reached a tentative $1.9+ million settlement in an action filed against Kash n' Karry Food Stores, Inc. on behalf of all current and former female management and non-management associates of the company who worked at any time between June 10, 1999, and August 22, 2003, in Kash n' Karry's retail operations and completed their 90-day probationary period on or before August 22, 2003. Claims must be postmarked no later than November 21, 2003, to be considered valid.
