The terrorist attacks of the past two years have created a time to make big profits as well as a time of uncertainty. A class action has been filed against German drug manufacturer Bayer AG and several New Jersey hospitals on behalf of New Jersey postal workers who allege that they have suffered serious side effects from taking the antibiotic ciprofloxacin (Cipro) in the aftermath of the anthrax attacks in 2001. The action alleges that Bayer failed to warn the postal workers of the potential side effects of Cipro, thereby violating the New Jersey Consumer Fraud Act.

A class action complaint alleging Gateway Regional Medical Center in Granite City, Illinois inflated charges for uninsured patients will be heard on the hospital's motion to dismiss on Sept. 26. Circuit Judge Daniel Stack will hear the case in place of the retired Judge Philip Kardis. Kimberly Chronister, Lisa Golino, Julia Holman, Linda Hughes, and Robert Orasco accuse the hospital of charging unfair and unreasonable prices for medical care. The plaintiffs all reside in Illinois.

The parties have reached a tentative $10.2 million settlement of a class action filed against managed healthcare company Physician Corporation of America (Nasdaq: PCAM) and certain of its officers and directors by stockholders who purchased the company's common stock between March 31, 1996, and March 31, 1997, and still owned the stock on the latter date. To recover under the settlement, a completed proof of claim postmarked no later than December 22, 2003, must be mailed to the claims administrator.

Reduction and even elimination of health care benefits is a growing source of controversy between U.S. corporations and their retirees. Two related class actions have been filed against Rexam, Inc.--the current owner of the American National Can Company--and the Rexam Retired Employees Group Insurance Plan on behalf of employees who retired from National Can and who now allege that Rexam has violated the federal Labor Management Relations Act and the Employee Retirement Income Security Act (ERISA) by unilaterally reducing retiree medical benefits.

We still don't know who sent those two letters filled with anthrax that killed two U.S. Postal workers in Washington, D.C. A $100 million class action has been filed against the U.S. Postmaster General John E. Potter and several other administrative personnel at the U.S. Postal Service processing and distribution center on Brentwood Road in Northeast Washington on behalf of Brentwood postal workers who allege that their Fifth Amendment right to due process of law under the U.S. Constitution was violated when they were exposed to anthrax but not treated in the same efficient manner as victims on Capitol Hill who were exposed when a letter containing the deadly virus was opened in the office of Senator Tom Daschle on October 14, 2001.

A class action has been filed against Madisonville, Kentucky’s Trover Regional Medical Center, on behalf of thousands of patients going back a decade or more, who allege that their medical films were misread, overlooking potentially serious conditions, including cancer.
