Other Drugs / Medical Cases of Interest

There is irony in the way big American drugmakers’ pricing policies hurt the very people the companies are supposed to be helping. A class action has been filed against drugmaker Pfizer, Inc. on behalf of persons who paid out-of-pocket expenses for the hypertension treatment Accupril (quinapril hydrochloride tablets), who allege that the company has it legally maintained a monopoly on the drug by delaying generic competition, in violation of state and U.S. antitrust laws.
 
A class action has been filed against Aetna Health, Inc., a subsidiary of healthcare giant Aetna, Inc., on behalf of Pennsylvania residents (1) who, between September 26, 1999, and the date of the final judgment in the action, were injured in a motor vehicle accident while insured under an Aetna heathcare plan; and (2) whose tort recovery from the accident was subject to a lien asserted by Aetna. The action seeks compensatory and statutory damages for monies collected via the liens as well as injunctive and declaratory relief.
 
The parties have reached a tentative nationwide $9+ million settlement in a class action filed against Bayer, Inc. on behalf of Canadians who live in any province other than British Columbia, and who were prescribed the anti-cholesterol drug Baycol (cerivastatin) and family members of deceased Canadians who took the drug. The action alleges that the drug causes the serious adverse muscle reaction known as rhabdomyolysis, and may also cause acute renal failure. The court has apparently not yet set a claims deadline-- persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.
 
A federal class action has been filed against the Kentucky based Trover Clinic Foundation and its associated network of hospitals and medical officers. The suit alleges that over 415 individuals who sued Trover Clinic in state court were subsequently contacted and told that they would not be treated at any Trover affiliated facility unless they accepted the terms of a settlement offer put forward by Trover. Many of the plaintiffs are cancer patients who would have been forced to seek treatment out of state as a result of Trover's refusal to treat them.
 
InterMune Inc., a biopharmaceutical company based out of California, has agreed to pay the government $36.9 million to resolve criminal charges and civil liabilities in connection with allegations of illegally promoting Actimmune for treatment of idiopathic pulmonary fibrosis (IPF).
 
A class action has been filed against chemical and pharmaceutical manufacturer Cambrex Corporation (NYSE: CBM) and certain of its officers and directors by stockholders who purchased the company's common stock between October 21, 1998, and July 25, 2003.
