A national class action has been filed against prescription drug plan operator Express Scripts, Inc. on behalf of all U.S. citizens who were or are participants in or beneficiaries of any employer-provided prescription benefit plan (1) that required participants or beneficiaries to pay a percentage co-pay for prescription drugs and (2) for which Express Scripts, Inc. or one of its predecessors-in-interest or subsidiaries serves or has served as the plan's provider of prescription drugs at any time from October 1, 1997, through the present. The action is brought under the Employee Retirement Income Security Act (ERISA) and claims that Express Scripts breached its fiduciary duty to plan participants and beneficiaries in several ways. The participants are seeking declaratory and injunctive relief and a court order requiring Express Scripts to make an accounting of and reimburse consumers and benefit plans all monies earned through allegedly unlawful activities.
 
The parties have reached a tentative settlement apparently valued at more than $13 million in a class-action filed against the Kentucky Department for Medicaid Services and the Kentucky State Cabinet for Health Services on behalf of thousands of Kentucky residents who lost their eligibility for nursing home or in-home care because of stricter rules that were enacted in April 2003. Eli Lilly and and the FDA notified healthcare professionals of revisions to the precautions//Hepatotoxicity section of the prescribing information for Cymbalta (duloxetine hydrochloride), indicated for treatment of major depressive disorder and diabetic peripheral neuropathic pain.
 
A class action has been filed against Rapid City Regional Hospital, a hospital located in Rapid City, South Dakota for not providing charitable care to uninsured patients as required under their tax-exempt status. The class action has also been filed against the American Hospital Association, the national organization that represents and serves hospitals, health care networks, and their patients and communities for misleading the hospital on matters of charitable care.
 
An administrative proceeding has been filed by the Federal Trade Commission against Boston-area marketers Direct Marketing Concepts, Inc., ITV Direct, Inc., along with business partners Healthy Solutions, LLC, and Health Solutions, Inc., Triad ML Marketing, Inc., and King Media, Inc., on behalf of all persons who purchased the dietary supplements “Supreme Greens with MSM” and “Coral Calcium Daily.” The action alleges that the companies falsely promoted the supplements as a means to treat, cure, and prevent cancer and other diseases, and to cause significant weight loss, in violation of the federal FTC Act.
 
Bristol-Myers Squibb confirms that the antibiotic Tequin, which has been linked to serious blood sugar complications, is being taken off the market. The company will stop making and selling the drug and return its rights to Kyorin Pharmaceutical Company in Japan.
