Other Drugs / Medical Cases of InterestA national class action has been filed against New York City's Interfaith Medical Center on behalf of all consumers who have received, since November 6, 2002, a collection letter from either South Side Collection, Inc. or National Revenue, Ltd in an attempt to collect a debt for Interfaith. The consumers allege that these letters are actually generated by Interfaith itself and therefore violate the federal Fair Debt Collection Practices Act. Consumers are seeking actual damages, statutory damages, and injunctive and declaratory relief.
Kahn Gauthier Swick is investigating possible legal actions against Cordis Corporation on behalf of persons who have been injured by the company's Cypher coronary stent. On October 29, 2003, the federal Food and Drug Administration issued a warning that a significant number of adverse effects had been reported since the Cypher stent was approved on April 24. Both blood clotting and hypersensitivity reactions have been reported. A class action has been filed against drug manufacturer Impax Laboratories, Inc. (Nasdaq:IPXL) and certain of its officers and directors by stockholders who purchased the company’s common stock between May 5, 2004 and November 3, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholders seek to recover compensatory damages for the loss of value of their stock. Several class actions have been filed against medical products and services company Cardinal Health, Inc., (NYSE:CAH) and certain of its officers and directors by stockholders who purchased the company's common stock between October 24, 2000, and June 30, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. A class action has been filed against New York City Health and Hospital Corporation for retaliation and violations of overtime laws. The complaint alleges that Marjorie Barnwell worked for Kings County Hospital, but was not paid for overtime and that the Hospital retaliated against her when she confronted them. Barnwell is suing for unpaid overtime compensation and retaliation. The class has been certified in an action filed against O'Neal, Jones & Feldman Pharmaceuticals, and Carter-Glogau Laboratories on behalf of all persons who received injections of E-Ferol, a vitamin E supplement later to be found toxic.
