"Double Billing" Class Action Filed Against Cingular Wireless

A class action has been filed on behalf of California residents against Cingular Wireless claiming that the company failed to adequately disclose its practice of charging consumers multiple times for the same airtime minute of cell phone use. The action is titled Paton v. Cingular Wireless, et. al., No. 428855, and is pending in the California Superior Court for the County of San Francisco.

The lawsuit alleges that "Cingular bills Airtime used by customers in one-minute increments," and that because of "the unreliability of the Cingular wireless system," when dropped calls "force customers to reinitiate the same connection or call . . . within the same minute," Cingular bills customers multiple times for the same minute. In some instances, customers have been billed three times for a single airtime minute.

The case was filed on July 16, 2004. At this time, additional consumers are needed to continue the case. A consumer class action lawsuit was filed on behalf of persons who purchased Garnier Fructis hair products during the past four years, believing they actually strengthened hair. Both the labeling and advertising of Defendant L'Oreal's Garnier Fructis shampoos and conditioners claim to make hair five times stronger and five times smoother.
 
Exterior sealants are formulated to prevent mildew and make surfaces waterproof. The court has granted final approval to the parties' $55 million settlement in a class action against sealant manufacturer Behr Process Corporation on behalf of all residents of 19 western Washington counties who purchased and applied any of four exterior wood sealants to their property there, at any time between May 28, 1992, and March 17, 2003, and who experienced mildew growth upon those surfaces after May 28, 1994.
