British Columbia Public Service Benefits Class Action Certified

A class action proceeding has been certified against the Province of British Columbia (the "Government") on behalf of the members of the British Columbia Public Service Pension Plan (the "Plan Members") who were presently entitled to receive premium-free Medical Services Plan Benefits and Extended Health Care Benefits, and who retired on or before November, 2002.

The representative plaintiff for this class action is Frederick Bennett. The plaintiff is represented by the law firm of Albert Peeling in Victoria, as well as Koskie Minsky LLP in Toronto and Underhill Faulkner Boies Parker Law Corporation in Vancouver and Victoria.

Plan Members claim damages against the Government for breaching fiduciary obligations with respect to the provision of premium-free Medical Services Plan Benefits and Extended Health Care Benefits. Additionally, Plan Members who were directly employed by the Government claim damages for breaching contractual obligations with respect to the applicable medical benefits. On November 13, 2007, Madam Justice Dorgan of the Supreme Court of British Columbia approved the release of the attached Notice to all of the amembers of the Class, setting out the nature of the claim.

The action alleged that the dealerships failed to give adequate disclosure of finance and insurance products on its standard sales and lease agreements, in violation of Florida consumer protection law. 1.5 million persons of all ages died in the Armenian Genocide of 1915. The parties have reached a tentative $20 million settlement in an action filed against New York Life Insurance Company on behalf of descendants of victims massacred in the Armenian Genocide of 1915, who allege that the company failed to pay life insurance policy proceeds to them. A class action has been filed against Aetna Health, Inc., a subsidiary of healthcare giant Aetna, Inc., on behalf of Pennsylvania residents (1) who, between September 26, 1999, and the date of the final judgment in the action, were injured in a motor vehicle accident while insured under an Aetna heathcare plan; and (2) whose tort recovery from the accident was subject to a lien asserted by Aetna. The action seeks compensatory and statutory damages for monies collected via the liens as well as injunctive and declaratory relief.

The issue of corporate health plan prescription contraceptive coverage is growing quickly.
