Pet Owners Seek Class Action Lawsuit

Menu Foods recalled 60 million containers of its "cuts and gravy" style wet pet foods, sold under nearly 100 store labels and major brands across North America. It did so after cats fell sick and died during routine company taste tests.

It is not clear how many pets may have been poisoned by the apparently contaminated food, although anecdotal reports suggest hundreds if not thousands have died. The U.S. Food and Drug Administration has received more than 8,000 complaints while the company has fielded 300,000 calls from consumers. The company has only confirmed the deaths of 15 cats and one dog. There is no central database tracking pet deaths in the United States.

Numerous pet owners around the country have sued or are considering legal action against Menu Foods. Some are seeking class action status.

Ontario-based Menu Foods has taken a low-key approach to the recall, expressing concern for people who have lost pets and offering to pay veterinary bills if a pet's illness or death can be directly linked to the food, but admitting no wrongdoing.

Dog and cat food sales in the United States reached over $14.3 billion in 2005, according to the Pet Food Institute that represents manufacturers of commercial pet food.

The U.S. Food and Drug Administration said recalled pet foods contained melamine, a chemical used to make plastics, but that its tests failed to confirm the presence of a rat poison, aminopterin, reported by the New York State Food Laboratory. The FDA said it also found melamine in wheat gluten used as an ingredient in the wet-style products. Still, it was not immediately clear whether the melamine was the culprit in the deaths.

Nestle Purina PetCare Co. recalled all sizes and varieties of its Alpo Prime Cuts in Gravy wet dog food with specific date codes. Purina said a limited amount of the food contained a contaminated wheat gluten from China.

Additionally, Del Monte Pet Products announced it was voluntarily recalling some of its dog and cat treats with certain date codes. The affected brands are Jerky Treats Beef Flavor Dog Snacks, Gravy Train Beef Sticks Dog Snacks and Pounce Meaty Morsels Moist Chicken Flavor Cat Treats. The company said two other products sold under private labels also are affected: Ol' Roy Beef Flavor Jerky Strips Dog Treats and Ol' Roy Beef Flavor Snack Stick Dog Treats.

Several lawsuits have been filed, seeking to represent pet owners affected by the tainted pet food.

Other Family Cases of Interest

The parties have reached a tentative settlement valued at $12,457,350 CDN in a class action filed against Bristol-Myers Squibb Canada Company and Bristol-Myers Squibb Company on behalf of all Canadian residents who purchased Stadol NS nasal spray in Canada from July 1, 1994, to July 1, 2004. The action alleged that the nasal spray is addictive and that the defendants did not adequately warn patients of the possibility of addiction. The court has apparently not yet set a claims deadline-- persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.
 
A class action has been filed against the Vatican, on behalf of Americans who allege that the Roman Catholic Church has orchestrated a massive decades-long cover-up to protect priests who molested them as children. The action accuses the Holy See of negligence and claims that it is ultimately responsible for the abuses, and seeks unspecified compensatory and punitive damages.
 
Washington, DC attorneys filed a consumer class action lawsuit on July 20, 2005 in the Circuit Court of Cook County, Illinois against Hyatt International Corporation. The claim is on behalf of all guests of Hyatt's hotel in Moscow since July 2002. The complaint alleges that Hyatt made deceptive and misleading representations through its worldwide, internet based reservation system on the rates that would be charged at the Ararat Park Hyatt in Moscow, Russia.
 
Holiday Village East residents Harry and Rita Schmoll and Leonard and Eleanor Egnack filed a lawsuit in November 2002, and the action was later granted class-action status. The lawsuit alleged that some of the utility rooms, which house gas-powered furnaces, hot-water heaters and dryers, were not properly ventilated. All were built on or after Nov. 30, 1992.
 
A class action has been filed on behalf of students of Native American descent in the Perry township school system. The complaint alleges a pattern and practice of inappropriate labeling and mistreatment of these children and inappropriate handling of complaints regarding this treatment.
 
A class action has been filed against U.S. Bank and its Indiana collections attorney, Septtimous Taylor, by Indiana residents whose mortgage is held by U.S. Bank and who, at any time since October 10, 2001, were charged foreclosure fees and court costs although foreclosure actions had not been filed in court. Additionally, the action claims that Taylor violated the federal Fair Debt Collection Practices Act. The action seeks restitution and compensatory and statutory damages.
